SMS Terms and Conditions

SMS Terms and Conditions
Joyful Minds LLC SMS Terms and Conditions
These SMS Terms and Conditions govern the provision and use of text message (SMS) services offered by Joyful Minds LLC ("we," "us," or "our") to our patients and their authorized guardians or representatives ("you"). By opting in to receive SMS messages from us, you agree to these Terms and Conditions.
1. SMS Program Description
Our SMS service is intended to provide you with important, non-urgent information related to your care, which may include:
-
Appointment reminders and confirmations.
-
Billing and payment notifications.
-
Requests for administrative information.
-
Urgent operational updates (e.g., unexpected office closures, service disruptions).
We will NOT use SMS for:
-
Diagnosis, treatment, or clinical advice.
-
Emergency communications.
-
Discussion of sensitive clinical information.
2. Opt-In and Consent
You will only receive text messages from us if you provide explicit, written consent ("opt-in") to receive them. By submitting your consent, you confirm that you are the subscriber of the mobile number provided or an authorized user of that number.
-
Age of Consent: If the patient is under 18, the parent or legal guardian must provide consent on the patient's behalf.
-
Frequency: Message frequency is typically low and will be determined by the administrative needs of your care (e.g., one to five messages per week, though this may vary depending on your appointment schedule).
-
Cost: Message and data rates may apply. Check with your mobile carrier for details. You are responsible for any charges incurred.
3. HIPAA and Privacy
Text messaging is not a fully secure method of communication. While we implement reasonable safeguards to protect your information, using SMS inherently carries some risk to the privacy of your protected health information (PHI) compared to secure patient portals or phone calls.
-
By opting in, you acknowledge and accept this risk and consent to receive administrative communications that may contain limited PHI (e.g., your name, appointment time).
-
We will make reasonable efforts to limit the amount of PHI disclosed in text messages.
-
Our use of your information is governed by our Notice of Privacy Practices (HIPAA) and our General Privacy Policy, available at [Link to your practice's Privacy Policy].
4. Opt-Out and Stopping Messages
You may withdraw your consent and opt-out of receiving SMS messages at any time.
-
To stop receiving all text messages from Joyful Minds LLC, reply with the word STOP to any message you receive.
-
You will receive a one-time final confirmation message indicating that you have been unsubscribed. After this, you will no longer receive any SMS messages from this service.
-
To resume receiving messages, you will need to re-enroll by contacting our office.
5. Support and Assistance
For any questions, support, or assistance regarding our SMS service or these Terms and Conditions, please contact us using our standard communication channels during business hours:

6. Termination
Joyful Minds LLC reserves the right to suspend or terminate the SMS service to you, at any time, with or without notice, if we believe you have violated these Terms and Conditions. We may also change the messaging service or stop providing the service at any time.
7. Changes to Terms and Conditions
We may revise these SMS Terms and Conditions at any time. We will notify you of any material changes by posting the updated terms on our website or by sending you a text message. Your continued use of the SMS service constitutes your acceptance of the revised terms.
